The Argentine Supreme Court ratified the suspension of article 161 of the Audiovisual Communication Services Law of such country which limits the number of licenses per company and would force Clar?n Group to get rid of either its free-to-air TV channel (Cannel 13) or its MSO Cablevisi?n. The court decided to reject the appeal against Clar?n's caution measure submitted by the Argentine Government. Additionally, the court pointed out the need to fix "a reasonable limit" in virtue of such measure, a term that would last "at least two years". Therefore, the aforementioned issue would be solved after the next presidential elections to be held in 2011.
If such minimum term is confirmed, it would exceed the current President's, Cristina Fern?ndez de Kirchner, term, which ends in 2011. This would grant Clar?n greater future options, especially if the current official government, promoter of the Law, does not continue leading the country. According to former President Néstor Kirchner, such term expires in September next year. But according to La Naci?n newspaper, the court considers that such term should be much longer so as to enable both parties defend themselves during the trial that will solve the conflict.
The Court confirmed that the Audiovisual Communication Law is still valid in all other articles. "We still hope that (article 161) is applied this year", stated Gabriel Mariotto, head of the Federal Authority of Audiovisual Communication Services.
The Law remained unapplied over several months due to different cautious measures against it, which were finally revoked. However, so far, article 161, one of the most controversial articles that establishes that holders exceeding the number of licenses set by law shall disinvest over a term no longer than a year, has never become effective.
